Terms of Use

These terms apply to your use of the Candid Cycle and Calibrate apps, their companion web forms and related services (the “Services”), operated by John Salter Consulting Services (“we”, “us”).

By creating an account or using the Services you agree to these terms. If you respond to a review as a contributor, sections 4, 6 and 11 apply to you.

1. Apple’s licence

The apps are licensed to you under Apple’s standard Licensed Application End User Licence Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These terms add conditions for the Services and do not replace Apple’s licence or any rights you have under law. If these terms conflict with Apple’s licence about your licence to use the app, Apple’s licence prevails. Apple is not a party to these terms and is not responsible for the Services or for support. We are.

2. Accounts

You must be at least 16 and able to enter a binding contract. You must give accurate information, keep your password secure, and tell us if you suspect unauthorised use. You are responsible for activity under your account. One subscription may be shared only through the team seats (facilitator or administrator) included in your plan.

3. Subscriptions and billing

  • Plans are auto-renewing subscriptions, monthly or annual as shown at purchase. The price, what the plan includes, and any free trial are shown on the plan screen before you buy.
  • Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Apple may notify you of price changes and ask for your consent.
  • Manage or cancel in Settings > Apple Account > Subscriptions. Cancelling stops the next renewal. You keep access until the end of the period you have paid for.
  • Free trials: any trial terms are shown before you subscribe and are governed by the App Store offer. Unless the offer says otherwise, any unused part of a trial ends when you purchase.
  • Allowances such as cycles or workspaces per month, participants, team seats and reassessments are as stated for your plan. They may reset on renewal, and unused allowances do not roll over unless stated.
  • Refunds for App Store purchases are requested from Apple at reportaproblem.apple.com. This does not limit any remedy you have under consumer law. If the Services are faulty or do not match their description, contact us as well.
  • Deleting your account does not cancel your subscription.

4. Your content

Ownership. You and each contributor keep the rights you already have in the content you submit. We do not claim ownership of your content or of the reports prepared for you.

What you allow. You allow us to store, process and transmit content to provide the Services, including AI processing as described in the Privacy Policy, and to include edited, anonymised excerpts of contributor responses in reports for the account holder. This permission ends when the content is deleted, except for the limited retention described in the Privacy Policy.

Your responsibilities as an account holder.

  • You must have the right to collect the responses and to use the resulting report.
  • You must tell your contributors, before they respond, how their responses will be used and that they are processed by AI and service providers. The contributor notice on our forms helps, but you remain responsible for your own communications with them.
  • You must not submit unlawful, defamatory or harassing content, or information you are not entitled to share.
  • You must not try to identify anonymous contributors or get around anonymity. This includes asking us to.

5. AI-generated reports

Reports are drafted with AI. You, as the account holder, must review and approve a report before it is released. AI output may be incomplete or inaccurate. Reports are decision-support tools and are not professional, legal, HR, financial or safety advice. You are responsible for decisions you make using a report.

6. Acceptable use

You must not:

  • reverse-engineer the apps, except as the law or an open-source licence allows;
  • interfere with or try to bypass security or access controls;
  • use automated means to extract data from the Services;
  • resell the Services or share access outside your plan;
  • use the Services to harm, harass or unlawfully discriminate against others.

7. Changes, suspension and discontinuation

We may change the Services for operational, security, legal or product reasons. If a change materially reduces what a paid plan provides, we will give at least 30 days’ notice, except where urgent security or legal reasons require sooner. In that case you may cancel, and we will support your request to Apple for a refund of any prepaid period affected.

We may suspend or end your access if you materially breach these terms or if the law requires. Where reasonable we will tell you why and allow you to fix the problem first. We may suspend immediately where there is a serious security risk or unlawful conduct.

If we discontinue the Services, we will give at least 30 days’ notice, except where urgent reasons prevent this, and a chance to download your reports.

We do not promise uninterrupted or error-free operation.

8. Consumer rights and liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund and compensation for reasonably foreseeable loss.

Subject to that, and to the extent the law allows:

  • the Services are provided “as is”;
  • we are not liable for indirect or consequential loss, or for loss of profits or goodwill; and
  • our total liability for all claims arising from the Services is limited to the greater of the amount you paid us through the App Store in the 12 months before the claim and AUD 100.

Where the Australian Consumer Law allows us to limit liability for a failure to the re-supply of the service or the cost of re-supplying it, we may do so. This section does not limit liability for death or personal injury, fraud, or anything else the law does not allow us to limit.

9. Ending your use

You may stop using the Services and delete your account at any time. When your account ends, your right to use the Services ends. Sections that by their nature should continue (such as 4, 5, 8 and 10) continue after your account ends.

10. Governing law

These terms are governed by the laws of South Australia. The courts of South Australia have non-exclusive jurisdiction. This does not affect any consumer rights you have where you live that cannot be excluded.

11. Contributors

If you respond through a web link:

  • you confirm you are 16 or older;
  • you must not submit unlawful content or content you are not entitled to share;
  • you must not include names or identifying details of other people unless necessary; and
  • you understand the Contributor Notice and the Privacy Policy.

12. Changes to these terms

We may update these terms. We will post the new version with a new effective date. For material changes that disadvantage account holders, we will give at least 30 days’ notice in the app or by email before they apply to you. If you do not accept the change, you may cancel before it applies and section 7 applies to any prepaid period. Using the Services after the effective date means you accept the update, except where the law requires your express agreement.
